Terms of Service

Please read these Terms of Service ("Terms") carefully before using Built Estimator software or the Built Estimator Cloud subscription service ("Service") operated by Built Estimator ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Use of the Service

Built Estimator grants you a limited, non-exclusive, non-transferable license to use the software for your internal business purposes. You may not:

• Reverse engineer, decompile, or disassemble the software
• Sublicense, resell, or redistribute the software or your account access
• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' data

2. Cloud Subscription

The Built Estimator Cloud plan is a monthly subscription billed at $89 per seat per month. Subscriptions are billed in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial months.

We reserve the right to modify pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@builtestimator.com if you suspect unauthorized access.

4. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Project data stored in Built Estimator Cloud is encrypted and associated with your account. We do not sell your data to third parties.

5. Intellectual Property

Built Estimator and all associated software, logos, and content are the intellectual property of Built Estimator. Nothing in these Terms transfers any ownership of our intellectual property to you.

6. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements. Use the Service at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, Built Estimator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

8. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the Service. Continued use after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the applicable jurisdiction. Any disputes shall be resolved in the applicable courts of that jurisdiction.
